When you use NaviKite, our servers automatically store Information about the request in a Log File.  This information may include, and is not limited to, client IP address, time stamp, and activity (i.e. logged in, logged out, forgot password, etc.).

The NaviKite system aggregates user information to provide subscribing businesses (Subscriber) with a better understanding of the demographics of their customer base. A subscriber has the ability to communicate information to users that opt-in to receive its messages.  Subscribers may choose to deliver messages to a specific demographic profile within their user group, however, subscribers do not have the ability to view individual account information or any personal and/or identity-based information (such as name, email address or mobile phone number).

NaviKite may use your email address to communicate directly with you regarding NaviKite products, services and updates. Subscribers may communicate with you using your email address if you have elected to receive their messages, in the event that the mobile network is unavailable.

NaviKite shall use the information it collects, as outlined above, to improve existing products and services, or develop new applications.  Any information relating to user behavior shall be analyzed either in the aggregate or by subgroup; individual user data shall never be accessed.

All communication to the user’s mobile phone is on an opt-in basis. By creating an account on the NaviKite network, users agree to opt-in to all communications directly pertaining to the NaviKite network, products and services. When a user elects to activate a subscriber, he/she consents to receive all mobile offers from the subscriber and applicable email updates.  Email updates will only be sent through the NaviKite system by the subscriber.  User email addresses will not be provided to the subscribers.

WanderSmart Technologies LLC and the NaviKite network will not spam users or send unauthorized messages, which are defined as emails, SMS messages, text messages, instant messages, alerts or other communications from non-subscribers.  NaviKite will not give, rent, trade, sell or intentionally disclose your personal and/or identity-based information (e.g. name email address or mobile phone number) to any third party.  NaviKite will take every reasonable precaution to prevent disclosure of said information, and in the event that its efforts are unsuccessful, it shall notify the user of said disclosure immediately upon its discovery.  In the event that it is required by law to disclose any personal or non-personal information (including but not limited to the provisions of a court order, subpoena or search warrant, or in protection against liability or fraudulent/unlawful use, or in order to enforce the Terms of Use) NaviKite shall disclose only such information as is required.

Given the nature of the internet, WanderSmart Technologies LLC and the NaviKite network cannot absolutely guarantee that the data on its system will be protected from all forms of cyber abuse.  While precautions are taken to protect the privacy of user data, unauthorized entry into and use of the system, hardware or software failure, or other factors may compromise the security of user information. Under no circumstances will WanderSmart Technologies LLC or the NaviKite network be held liable for any damages resulting from an alleged breach of privacy for any reason.

Children under the age of sixteen (16) are not eligible to use our service and must not submit any personal information to us.

NaviKite is intended for use by users within the United States of America. As laws differ regarding privacy and data collection in other countries, users submitting information to create an account certify that they are either residents of the United States of America or they agree to be bound by the Terms and Conditions and Privacy Policy as they are enforced under law in the United States.

In the event of a Change of Ownership of the NaviKite network, all users will be notified with 30 days notice in writing by email to their registered user email account. Notification may also occur in the form of a message sent directly to the user’s mobile phone. Users will have the opportunity to cancel their account and remove their information from the NaviKite network prior to the transfer.

WanderSmart Technologies and the NaviKite network intend to update this Privacy Policy every six months with additional enforcements and protections for the user, if appropriate. Any user rights removed or diluted from the Privacy Policy will warrant written notification to the users in the form of an email sent to the registered user email account. Users will also find notice on the main page of the NaviKite network site indicating the updates to the Privacy Policy and current effective date. Users are urged to review this policy on a regular basis and be familiar with its details and ramifications as they apply to the user and the user’s information.
